DUTY OF PHYSICIAN AND SURGEON; MEDICAL PERFECTION NOT REQUIRED

A physician or surgeon is not necessarily negligent because he errs in judgment or because his efforts prove unsuccessful. He is negligent if his error in judgment or his lack of success is due to a failure to perform any of his duties as defined in these instructions.
